Terms of Service

1. Acceptance of Terms

These Terms of Service govern your access to and use of Send Softly ("the Service"). Your use of the website, app, package links, invite links, or related services constitutes acceptance of this agreement.

2. Description of Service

Send Softly is a private digital gifting service for creating packages of notes, surprises, memories, links, and timed moments that recipients can open over time. Features may change as we continue to develop the product.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information when registering. You may not share your account credentials with third parties.

4. Packages and Invites

You are responsible for the content you create, upload, send, or share through Send Softly. You should only send packages to people you have a legitimate reason to contact and should not use the Service to harass, threaten, impersonate, deceive, or spam others.

5. Subscriptions and Payments

Send Softly may offer free and paid tiers. Paid subscriptions, if available, are provided through the applicable app store on a recurring basis and may be subject to Apple's Licensed Application End User Licence Agreement (EULA).

• Billing. Payment is charged to your app store account at confirmation of purchase.
• Renewal. Subscriptions automatically renew unless cancelled before the end of the current billing period.
• Free trials. If offered, unused trial time may be forfeited when you purchase a subscription.
• Refunds. We do not process app store payments or issue app store refunds directly. Billing disputes and refund requests should be handled through the applicable app store.

6. Cancellation

You may cancel a subscription through your app store account settings. Cancellation takes effect at the end of the current billing period, and you may retain access to paid features until then.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Send abusive, deceptive, harmful, infringing, or unwanted content.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or security of the Service.
• Use the Service in a way that depletes resources or degrades the experience for others.
• Share your account credentials with third parties.

8. Right to Refuse Service

We reserve the right to refuse, suspend, or terminate service to anyone at any time, including for misuse, abuse of resources, or violation of these Terms, as determined at our sole discretion.

9. Intellectual Property

All content, features, and functionality of the Service are owned by Send Softly or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms. You retain ownership of content you submit to the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT PACKAGE DELIVERY, NOTIFICATIONS, OR UNLOCK TIMING WILL ALWAYS WORK WITHOUT DELAY.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEND SOFTLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY LOSS OF INCOME, DATA, GOODWILL, CONTENT, OR EMOTIONAL DISTRESS. YOUR SOLE REMEDY IS TO DISCONTINUE USE OF THE SERVICE.

12. Indemnification

You agree to indemnify and hold Send Softly harmless from any claims, damages, losses, or expenses arising from your breach of these Terms, violation of applicable law, or infringement of any third-party rights.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the updated version on this page and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms, misuse the Service, or if we decide to cease offering the Service. Upon termination, all licences and rights to use the Service shall immediately terminate.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions.
